Definitions

“Owner” refers to Melbourne Hire Co
-
“Hirer” refers to the person or company hiring items from the owner
-
“Equipment” refers to all hire equipment supplied by the owner to the hirer, including but not limited to chairs, tables and floral arrangements.

“Terms” means the terms and conditions set out in this hire agreement.
SECURING BOOKINGS, BONDS AND PAYMENTS
-
By securing a booking with a deposit or full payment, Hirer is agreeing to all the terms and conditions set out in this Hire Agreement

To secure a booking, 50% deposit is required
-
Balance of payment is required upon pick up or delivery

Minimum $100 security bond is required for all bookings. This may be higher depending on the scale of the event
-
Bond will be refunded upon the successful and safe return of equipment.
CONDITIONS OF HIRE

Length of hire will be as agreed upon between the owner and hirer. Any delay in the retuning of equipment outside of agreed upon days may result in extra fees.

Delivery and set up is available at an additional fee. Fee is determined on location and scale of event.

The hirer agrees to use equipment for its intended purposes only and not alter or damage any equipment.

Equipment must not be left outside uncovered over night or in extreme weather conditions to avoid damage. Any damage occurring from misuse or negligence will be charged.

For the length of the hire, the Hirer acknowledges full responsibility for the equipment and is liable for any lost, stolen or damaged equipment

If chairs are lost, stolen or damaged beyond reasonable repair, Hirer will be charged for the replacement of each chair at $70
-
Any lost, stolen or damaged floral arrangements will be charged accordingly at a minimum of $50
-
When returning chairs, cushions must be removed from chairs before stacking.
CHANGES AND CANCELLATIONS TO BOOKINGS

Changes to bookings must be agreed upon in writing between the Owner and Hirer minimum 14 days prior to delivery date. Changes made any earlier than 14 days may result in further fees.

Any cancellations must be made in writing,

Cancellations made 30 days or more prior to event will receive a full refund of deposit.

Cancellations made less than 30 days before the event may result in a full or partial loss of deposit.

The Owner may terminate the hire at any time, providing written notice. If the Owner terminates the hire then a full refund of any money paid will be issued. The Hirer will have no claims for such termination.
INDEMNITY & FORCE MAJEURE

The Hirer assumes the full risk of and indemnity against any and all property damage and/or personal injury resulting from the use of Owner’s hire equipment and holds the Owner harmless.

The Hirer releases the Owner from and agrees to indemnify the Owner of any thirds party claims, actions, costs, expenses and demands for damage or injury to person or property arising directly or indirectly form the use of equipment covered by these terms.

​In the event that the Owner is unable to provide hire equipment due to unforeseeable and unavoidable circumstance such as but not limited to natural disasters or governmental or societal actions, the Hirer may reschedule the booking at no charge subject to availability. Where the Hirer does not wish to reschedule the booking, any monies paid to the Owner will be forfeited and no further payments will be required.
